Evidence Checklist: Security Deposit Dispute

Filing at the RDSC without the right evidence significantly reduces your chances of success. This checklist covers every document you should gather before and after vacating a Dubai property — so that if your landlord wrongfully withholds your deposit, you are fully prepared.

Use this checklist whether you are filing a pre-emptive case before problems arise, or responding to a landlord who has already withheld your deposit. Each item notes why it matters and how to obtain it if you don't already have it.

TIER 1 — ESSENTIAL (case may fail without these):

☐ Ejari Tenancy Certificate
  Why: Proves the legal tenancy relationship and contract terms.
  How to get: From your original Ejari registration (save the PDF). Can be retrieved from Dubai REST app.

☐ Signed Move-In Handover Report
  Why: Establishes the baseline condition of the property at the start of the tenancy. Pre-existing defects documented here cannot be charged to you.
  How to get: From your landlord or agent at move-in. If you don't have it, request a copy immediately — before any dispute arises.

☐ Original Security Deposit Receipt
  Why: Proves the amount paid and the date.
  How to get: Bank transfer confirmation, cheque image, or a signed receipt from the landlord.

☐ Move-Out Photos/Video (dated)
  Why: Documents the property condition when you left.
  How to get: Take timestamped photos and video on departure day — every room, every surface, every appliance. Use your phone's default camera (auto-timestamps in EXIF data).

☐ Move-Out Handover Report (if signed)
  Why: If both parties signed a check-out report, this is the primary record of the condition at handover.
  How to get: From the move-out inspection process. Insist on being present and request a signed copy.

TIER 2 — STRONGLY RECOMMENDED:

☐ Correspondence with Landlord (WhatsApp/Email)
  Why: Shows the timeline of deposit return requests and the landlord's responses (or non-responses).
  How to get: Export WhatsApp chat as a PDF. Screenshot email correspondence. Include read receipts where possible.

☐ Professional Cleaning Receipt
  Why: Proves you left the property in a cleaned state and challenges any cleaning deduction.
  How to get: Engage a licensed cleaning company on your departure date and keep the VAT invoice.

☐ DEWA Final Account Statement
  Why: Confirms utilities were properly closed at your departure.
  How to get: Request from DEWA after closing the account.

☐ Formal Demand Letter (sent to landlord)
  Why: Shows you followed proper escalation before filing — relevant to the RDSC's assessment of reasonableness.
  How to get: Keep a copy of the demand letter you send, with evidence of delivery.

TIER 3 — VALUABLE IF AVAILABLE:

☐ Contractor Quotes for Disputed Repairs
  Why: Provides independent evidence of the market cost of any repairs the landlord claims to have done.
  How to get: Obtain 2-3 quotes from licensed Dubai contractors for the same work.

☐ Appliance Service Records
  Why: If the landlord claims an appliance was damaged, your service records show the appliance was maintained and functional.
  How to get: Retain receipts for any maintenance or servicing you arranged during the tenancy.

☐ Witness Statement (building management, neighbours)
  Why: Third-party confirmation of the property condition can be persuasive.
  How to get: Ask the building management or a neighbour to provide a brief written statement.

☐ Landlord's Itemised Deduction Schedule
  Why: The landlord's own document setting out what they claim and why — needed to dispute specific items.
  How to get: Request this in writing if the landlord withholds all or part of the deposit.

Why This Works

The three-tier structure (essential, strongly recommended, valuable if available) helps tenants prioritise without being overwhelmed. Not every item will be available or practical to obtain — the tier system communicates relative importance clearly.

Including 'How to get' for each item transforms a passive checklist into an action guide. Tenants who realise they don't have the move-in report, for example, can still act immediately to request it before a dispute arises.
